MALTREATMENT DETERMINATION - Exhibit O

The State said that a note that Steve had made on his iPhone on March 22nd synced to the Cloud on August 3rd. In fact, the note, containing the bitcoin address appeared in the Cloud and synced to Steve's phone. Had he truly been the one to make the note and then delete it, it would have been deleted from the Cloud by August 3rd. Furthermore, it would have synced immediately to the Cloud, not taken 4 and a half months.

Prosecutor Fred Fink said that, "it was absolutely vital for the State to prove 'dogdaygod' was, in fact, Stephen Allwine." It was only Mark Lanterman who suggested they were one and the same. The F.B.I. had previously investigated the case and did not connect the two.

The arrival of the medical examiner to the crime scene at 11:31 PM puts Amy's death sometime after 5:31 PM, after Steve had left. Although the prosecutor's case depended on Amy being murdered in the afternoon, when the ME examined her at 11:31 PM, he said Amy had died 4-6 hours earlier.
